Errors Prescribing Medicine

The incorrect prescription of medications can occur sometimes due to dispensing errors by a pharmacist. If this has happened to you, and you have suffered as a result, you may be entitled to make a personal injury claim*. Please contact us for advice on how best to proceed.

Types of Prescription Errors can include:

  • Wrong prescription
  • Incorrect dosage
  • Wrong combination of medication
  • Known allergy to medication not considered
  • Dispensing errors

It is the norm to visit your GP when you are sick. Often you will be prescribed medication to overcome the illness. Errors in your prescription can occur for example if the treating doctor prescribes the wrong medication or an incorrect dosage and this leads you to suffer unintended side effects. If the issue involves an incorrect medication or dosage, liability may lie with the doctor who prescribed it.

Medication can also be harmful when taken in combination with other medication. Doctors should be aware of medication that should not be taken together. If a doctor prescribed a medication that should not be combined with another medication that a you as patient are taking and you suffer because of it you may be entitled to make a claim for financial damages.

A doctor may also prescribe medication without checking your medical history. If a doctor does this and you are caused to suffer an allergic reaction which has serious consequences you may have a claim in medical negligence.

These prescription errors can also occur in a hospital setting.

Prescription errors may also occur where the treating doctor has given you the correct prescription and the pharmacist dispenses a different medication or the incorrect dosage of the medication and you suffer unnecessarily as a result. Pharmacists have a duty of care to the people who ask them to fill a prescription. If a pharmacist's error caused you injury, then you may have a valid medical negligence claim.

If you think you may have been prescribed medication in error or, medication was dispensed in error please do not hesitate to contact our team at HOMS Assist.

You may take legal action after  you have been involved in an accident or injured because of somebody else’s actions or negligence*.

Personal injury claims generally involve:

  • A plaintiff or claimant  – this is the person making the claim (you).
  • A defendant – the person(s) you are making the claim against.
  • Your solicitor
  • PIAB – Personal Injury Assessment Board (often called the Injuries Board). PIAB assesses most  personal injury claims before any further steps are considered.

What Are the Common Injuries Sustained In Accidents?

For every type of accident, whether a car crash, a slip and fall, or a product related injury, there is a wide array of injury types that can occur. Every part of the body is susceptible to different forms of injury and the forces applied upon the body when an accident occurs will dictate the kind of injury as well as the severity.

As a personal injury law firm with over 50 years experience representing injured parties Ireland we understand the nature of various types of injuries. We are able to articulate the effects they have on a client’s life, and the types of medical care required, in the context of a personal injury case.
