Holidays are a time for deserved rest and relaxation. The last thing you want to happen is to be involved in an accident or suffer an illness whilst you are on holiday. If this happens and it is not your fault you may be entitled to make a claim* for compensation.
Accidents abroad and whilst on holiday could include:
If you have been involved in a road traffic accident whilst abroad and it was not your fault you may be entitled to compensation. Depending on the circumstances, such as when, where, the parties involved and how the accident occurred, you may be able to bring a claim here in Ireland even though the accident occurred abroad. Our solicitors can discuss the accident circumstances with you and advise you as to your options.
Airplane travel has made seeing the world so accessible, but sometimes accidents do happen such as items falling from overhead lockers, falls and incidents occurring while embarking or disembarking the plane. If an accident happened whilst you were travelling on a flight you may be entitled to compensation pursuant to the 1999 Montreal Convention whose rules govern such claims.
Holiday injury and accidents
Holidays are supposed to be a happy time but unfortunately, injuries and accidents can occur whilst you are on holiday such as slips, trips and falls. You may be able to bring a claim here in Ireland even if the accident occurred abroad, if certain preconditions are met according to the Package Holidays and Travel Trade Act 1995. Our solicitors can discuss the accident circumstances with you to ascertain if these pre-conditions are met.
Holiday illness and sickness
Holidays are a time for rest and relaxation but if you fall ill or become sick and it was not your fault you may be entitled to bring a claim for personal injury compensation*. Strict time limits do apply so contact us for advice without delay.
Injury whilst on a day trip or excursion
Day trips and excursions are often part of our holidays. If you were involved in an accident or suffered an injury that was not your fault whilst you were on a day trip or excursion organised by your tour operator as part of your holiday package you could be entitled to personal injury compensation* here in Ireland pursuant to the Package Holidays and Trade Travel Act 1995.
If you have become sick as a result of food poisoning whilst you were abroad you may be entitled to make a claim for compensation here in Ireland under the Package Holidays and Travel Trade Act 1995 even though the incident occurred abroad.
Making an accident abroad claim
After sustaining an accident or suffering an injury abroad there are specific timeframes in which to make a claim. This may vary depending on the country in which your accident occurred. If you think you may have been a victim of injury for which someone may be liable it is vital to contact a solicitor as soon as possible to seek advice. At HOMS Assist we have over 50 years’ experience in personal injury claims, including claims for accidents and injuries abroad and whilst on holiday. You can contact us at one of our offices in Dublin, Limerick or Cork to find out if you can make a claim.
